COURT DOCUMENTS UPDATED - see below

Here is one of two “missing” posters I have seen on the net in the last week (the other has no images of Ashley and does not have Lynne’s email address at the bottom). I have some questions I would like answered otherwise I file this in the file I have called “BT’s Bullshit”. There are already a lot of things in there, but I think I can fit another.

1) BT has said this was released and distributed by Lynne (Peach) and that he did not do it. That may be the case, but where did Lynne get the information from? How does Lynne know the final words heard from the child were, “Daddy please please come get me!!! Mommy is screaming and hit me. I want to come home.”?

2) My research has revealed to me that Brian has no legal, documented custody of Kaia in California or Maryland. If that is the case, how is she missing? (P.S. If you have custody in one state I don’t believe you have to file again in another). UPDATED: See Below

3) If I had a child and he/she was missing/abducted, my efforts in making a missing poster would A) probably be executed by the legal authorities if it was a valid complaint and B) have information about my child a la hair color, eye color, height, birthmarks, earrings, etc. Why is none of that information on the poster?

4) There have to be better images of BT’s daughter than the one’s placed on the poster. Why aren’t they used?

5) Why is there no Amber Alert issued in the state of MD or nationally?

6) Why is BT still touring when he claims his daughter has been abducted and is missing?

7) Why are people asked to contact Lynne (his online PR person and official site webmaster) with information (aside from addresses and phone numbers since they have them) instead of the authorities?

8) Why is there no phone number to call and contact the authorities with information?

9) Why haven’t I seen Kaia’s or Ashley’s or Sarah’s pictures on the America’s Most Wanted website?

10) The poster claims Kaia was abducted and taken across state lines. That would be a federal offense and 1st degree kidnapping. Why is that fact not stated or addressed?

11) The poster claims Kaia has been with Brian all school year… I’m assuming September 2007… preschool. We don’t know what the circumstances or agreements are that were made, but if Ahley lives in Brooklyn and Brian lives in MD, wouldn’t it be plausible that Ashley agreed it makes more sense for her to go to school in MD rather than Brooklyn? (P.S. Physical Custody is not legal custody).

12) I’m hearing that Brian has told several people that 4 bench warrants have been issued for Ashley’s arrest. I’m assuming in 4 states. That’s interesting, because I can’t find evidence of that anywhere through the Freedom of Information Act. Can anyone share with me the proof?

13) “Daddy please please come get me!!! Mommy is screaming and hit me. I want to come home.” is quite a complicated statement for a 3 1/2 year old. Who dialed the number to plead for her rescue? Kaia herself?

14) Why the hell was this “notice” and poster issued and distributed through Myspace first? Retaliation to Ashley’s Mom’s blog?

15) Why did this seemingly happen just days after Ashley’s Mom posted a few blogs about her daughter’s and BT’s troubled relationship which heavily implicated Brian was not as polished as he apparently passes off to everyone around him? Coincidence?

16) Why does a Google and Yahoo! news search for “Brian Transeau” BT Kaia come up with 0 results?

17) If Ashley is/was a degenerate parent, why would she have unsupervised visitation?

18) Why isn’t this on the front page of Brian’s official site?

19) Where are the details… any details… within the text of the (original)missing poster that will actually assist people to identify and find Kaia if she is actually “missing”? Car type and color, license plate number, etc.

20) Can someone please give me a single reason (and evidence) to believe any of this?

Here are Brian’s PUBLICALLY AVAILABLE, ACCESSIBLE filings in the state of Maryland to date over the incident. It appears there is nothing more than an issue over visitation and through Brian’s complaints, the judge wishes to speak with Ashley or her attorney(s) (i.e summons) instead of declaring her a felon or stating that she has violated any law in any way.

UPDATE:

The court has awarded Pendente Lite Custody to Brian. This means pending litigation and a hearing, BT has temporary custody of Kaia. It is not legal custody or finite.

“Temporary custody is subject to review based on the “best interests” of the child standard, to be discussed below. It is not an “initial” award of custody because it is understood to be temporary pending a full hearing. In order to be awarded temporary custody you must file a request for hearing and an order for temporary custody and support along with your Complaint for Custody or Divorce.”

P.S. I omitted the consensus area because I ran out of character space in this post and because my opinion is actually irrelevant. The facts are what will end up deciding this for me, personally… none of which can be confirmed yet.

What a mess.  It sounds like BT had no business fathering a child, though it wouldn’t be the first time such an event has happened nor the last.

I suppose it’s possible to kick and scream all you want and say BT is the Lord Almighty, but there’s really no arguing any of that information and research.  I wonder how many of the fine folks over at BTM will actually wake up from their daze and start using their own brains instead of listening to the putrid filth Peach and friends spew all over those joke boards. 

Too bad really… I used to have so much fun with the community as a whole.  Happy the folks here are still logical.

Al I have to say for myself is the same shit I’ve said from the beginning...I’m for resolution.  I’m not for Ashley, and I’m not for Brian...I’m for Kaia.  Regardless of what court says what and who wants to sling more trash than the other...what is going on right now is traumatic for that little girl.  I know that Ashley is her mother...and while it’s better that she’s with someone she knows, state-hopping and all this crap isn’t a healthy environment.  This also goes without saying that, when she’s older, ALL this mess is going to be pulled up and strewn all over school by one or more of her classmates.  It’s not a possibility...it’s a gurantee.  The effects of this will resonate in Kaia’s life for years, and nobody seems to give a damn.

I want both parents to appear in a court of law and boundaries to be set and ABIDED BY on both sides.  I want Kaia to be treated as a child...and not like a pawn in a game of “Who’s Got The Biggest Dick.” Everyone is completely preoccupied with defending themselves...legal this, heresy that, right this, wrong that.  There’s only concern for who is going to get the biggest “I told you so” when this is all over.  I think it’s fucked up beyond all repair.

I had sworn that I wasn’t going to post anything over here in regards to this shit-storm...but since my name was brought up, I felt I needed to retort.  Please read, Shane...since you’ve missed it so many times before...I’m NOT defending ANYONE.  I’ve never said anyone was right, or that anyone was better...because I don’t know.  All the court documents in the WORLD don’t give us the insight into what has really happened, nor what is happening now.  We can hear both sides of the story from the parents themselves...and we STILL won’t know.  The only truth...that is so blindingly apparent and still ignored...is that a little girl is being passed around like a beanbag, and nobody cares.  We can post all the documents, blogs, posts, proof, and shit we want...but at the end of the day, none of it will matter.  A judge will make a decision, and none of this will be brought up...not my opinon, not Shane’s, not Lynne’s...and all this animocity will sit in cyber-space to be brought up by Kaia herself when she’s old enough to Google.  Such a lovely thought, isn’t it?

And proper parenting with proper decisions and civil communication giving due respect to one another would have avoided all of it. Kaia will be fine. Everybody has shit, it’s just different shit.

I don’t deny any of that...but none of what you are doing is helping one bit, either.  This slam campaign...true or not...is what is going to haunt Kaia.  One of these days, she’ll find this thread (not to mention the other ones flying around)...and see court files that no child should ever see, her father called a liar (which, true or not, isn’t a pleasant thing), and the oh-so thoughtful mention that her father basically is’t fit to raise her (which I’m SURE was writ by someone who knows him personally and isn’t making such judgement from shit on a message board...right?).

Hate to be a cliche’ and reference Billy Joel...but it fits.  You didn’t start the fire...but you’re throwing gasoline on it every chance you get.  It’s burning plenty well on it’s own...believe me.

If you assume we’re talking only about the supposed “abduction,” this problem stems from Brian’s original wishfulness to keep the entire affair private—that is, until he decided it was an appropriate time to plaster the internet with MISSING posters filled with what most people (who are entirely unrelated to, and unaware of the crisis) are correctly identifying as subjective, slanderous trash. It’s his methodology that’s brought him under public scrutiny, and because Brian and Lynne have chosen to involve everyone, we have every right to deconstruct and question the bias we’re being fed.

I said to Brian on the phone and I’ll repeat here: I’ve been in Kaia’s shoes. My parents fought in court for over three years, and the resulting mess currently occupies five and a half volumes of records, all of which I read upon turning 18. It didn’t reflect on anything but the desperation of both my mother and father, and I didn’t hate them more or appreciate them less. What is critical, however, is what Kaia is currently going through. Children are most impressionable during the ages of 3 to 6, and Kaia is no exception.

That being said, I find the behavior of both Brian and Ashley to be despicable on their good days, and the situation is something that could have been avoided long ago. The board and all this publicity crap is going to disappear into the fringes of the internet as we know it. Don’t fool and flatter yourselves into thinking for one minute that we matter in all this.

Devon...while I hate that you had to go through what you did, there’s no gurantee that the “discovery” will go as smoothly for Kaia.  You were 18 when you found out, more than likely by your own choice.  And, if you were anything then like you are now, wiser and more mature than your age dictates.  Thankfully, you were able to process the information and come to a rational conclusion that didn’t alter your life or perception of your parents.  While I pray that it will go that smoothly for Kaia, there’s simply no gurantee that it will.  There’s no gurantee that she’ll ever find any of this or that she’ll ever know the full extent of what is taking place right now...and I can only pray that she’ll find out by her own choice on her own terms.  But again...there’s no way to forsee how it’s actually going to happen.

I concede that you have the right to dissect all that you’ve been given...I’ve been doing it, too.  Just please keep this kid in mind when you’re doing it.

I think this statement right here says a lot..  But I honestly doubt any of the people involved in starting this latest round of mudslinging will ever step up and admit that what they did was wrong and not in the best interest of the little girl involved.  BT is already telling people that he had nothing to do with the poster, so why doesn’t Peach-e-poo stand up and say that she made a mistake?  Why isn’t anybody asking all of the people that made a mission of spreading this rumor across the internet to go back out there and tell the truth?  Which is that BT knows exactly where his daughter is?

This is basically a, “I know what we did was wrong, but you are wrong as well” kind of statement.  Keep in mind that nobody here started a slam campaign.  Somebody very close to the situation posted a myspace blog, which got sent to a lot of people.  One of whom is a member here.  Then the powers that be at the BTM site, made the situation even worse by posting up that poster.  If the people involved want everybody to act mature and like grownups, maybe they should look in the mirror and direct that at themselves as well.

You can’t blame a bunch of people on the internet for calling bullshit when they see bullshit.  That is basically what all internet forums are about.  What is funny, is you have people putting out bullshit, and then they are standing behind it 100% even though they know it is bullshit.  Your comments here have pretty much told us what you think of this “abduction,” and that it never should have been posted on the internet but why haven’t you posted that over at BTM? 

If you read the comments posted here you’ll see that most of us have been saying since the beginning that none of this shit should be on the internet as it is a family matter… So why is it that you think this board as a whole is perpetuating some kind of attack against BT?

Well, for the record, since the “kaia” thing has come to light, there really hasn’t been a whole lot of “shit slinging”, as much as there has been honest, valid questions, none of which make any of us evil or terrible, just inquisitive.

Yeah, a lot (ok, all) of the shit I posted on the BTM boards was incendiary, but that was the point. It was fully intended to be malicious, because BT is a douchebag and I have no problem admitting it, but that had nothing to do with the Kaia situation.

He’s currently earning more excessive douchebag points by not just addressing these things.

Bottom line, the situation sucks, but they are the only ones making it worse. It’s got nothing to do with us or this board.

I’m pretty sure I’m going to get deleted and/or banned on BT Music - but as I posted on BTMusic:

I’ve been away forever, but I’ll state a few things that are terribly disturbing.

This whole Norg vs. BT music board is bullshit. They are both places created to admire Brian’s musical accomplishments. Norg has always had an intellectual elitist vibe while BT Music is the internet every person, but same initial purpose. Not Brian as a human being, but the music. They are two completely different things. It’s great to see Peach is still being Peach. Anything that she doesn’t agree with is lies, conspiracies, ignorant, or just plain wrong, and therefore should be deleted and/or banned. I would make a comment about First Amendment rights, but the Bill of Rights isn’t relevant to a non-government forum.

I don’t know the state of the whole Ashley/Brian custody situation. And no one here has come up with a definitive answer. 50/50 custody? Sole custody? Physical vs. legal custody? Many different answers have been given.

No one knows what each of the parents have said to the other. No one knows, besides what Brian states, what each parent believes the other is capable of. No one knows if Ashley and Brian had agreed for Ashley to take Kaia on a holiday and if Brian is using this for publicity. I mean, come on, New Year’s Eve is the biggest gig of the year, and can use all the publicity it can get. Or if Brian threatened the safety of Ashley, Ashley’s rights, or the safety of Kaia, and Ashley is running to protect Kaia from a perceived threat that may or may not have been expressed. Maybe Ashley is crazy and is just trying to hurt Brian. No one fucking knows. It’s a private family matter that shouldn’t be spread all over the internet through fucking publicist or Myspace. Granted, it’s an excellent tool, but there should be some official documentation behind it, which I haven’t seen.

I feel incredibly sorry for Kaia. I hope that whatever happens, in the end, she’s in a stable environment. My parents involved me in an insane custody battle/mind fuck that lasted for at least a decade. And yes, the FBI was called on a false kidnapping charge in which my parents agreed on where I would be. It’s fucked up. A child should not be forced to choose between his/her parents. They should be able to be fucking adults and work out what is best for the child so that the child gets to spend time with each parent in a healthy way. To use a child for a power play is egotistical and sick. To use a child as a tool to garner sympathy and publicity is even more sick.

As far as I have seen, Brian has had no issues exposing his daughter to the public for whatever his purpose. Call him a proud dad, but then you can’t call him a protective dad. Protective dads with any sort of celebrity don’t put their only child’s face out into the universe to see, especially someone with a history of personal space being violated like Brian has had.

Or you could just call me cynical. Brian has had an endless amount of drama surrounding him in the past, all of which he has been portrayed the victim. Brian is not a dumb man. If someone has been victimized as much as him, at some point they would have to catch on if they have any sort of intellect. So what should we expect from a Mensa member?

I love Brian’s music, I love seeing him live (although it’s been a few years, so it might have disintegrated from what I’ve heard), but I am tired of all the bullshit. He is amazingly talented, but that does not make him a perfect/good person. I could give my personal feelings, but they are based on a few superficial interactions and hersay, and wouldn’t be at all fair.

In the end, stop with the poor Brian sobiness. Poor Kaia is it. Poor Kaia. Poor Kaia for having parents caught up in celebrity. Poor Kaia for having parents that seemingly can’t see past their own personal goals of custody/parenting/power over each other. Poor Kaia for having to be caught up in a selfish custody battle. Poor Kaia for having to make the choice she’ll eventually have to make. And that’s not counting all of the other family bullshit/drama that people have to deal with, let alone children of brilliantly talented parents.

I suspect this will cause flames, which isn’t my intention. If Brian is like Mr. K-Fed and has been granted sole custody, then I wish him nothing but happiness and being reunited with Kaia. If not, then shame the fuck on him for instigating all this drama. In the end, I wish nothing but the health, happiness, and stability of 3-year-old Kaia. That is all that is relevant.

PS - I didn’t even mention the unfortunate picture on the flier that makes it look like BT is passing on his unfortunate hair fashion sense on to his little girl with that trashy pink streak.  Come on, she’s 3.  Way too young to do the whole Stefani thing.
